This one surprises people. If you own your home with someone else, there are two ways to own it. The deeds will say which.

As joint tenants, you own the whole house together. When one of you dies, the other automatically owns all of it. Your will doesn’t come into it. Your share can’t be left to anyone else.

As tenants in common, you each own a share, often half each. When one of you dies, your share passes under your will. That means you can leave it to your children, or into a trust, and still let your partner live there.

Most couples are joint tenants and have never thought about it. For many, that’s fine. But if you want to protect your children from sideways disinheritance, or you’ve been married before, it can matter a great deal.
